{"id":799,"date":"2026-05-13T04:55:42","date_gmt":"2026-05-13T04:55:42","guid":{"rendered":"https:\/\/alexi.pro\/?p=799"},"modified":"2026-05-13T07:19:15","modified_gmt":"2026-05-13T07:19:15","slug":"types-of-defective-contracts","status":"publish","type":"post","link":"https:\/\/alexi.pro\/index.php\/2026\/05\/13\/types-of-defective-contracts\/","title":{"rendered":"Types of Defective Contracts:"},"content":{"rendered":"<p>[feather\/share]<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone wp-image-800\" src=\"https:\/\/alexi.pro\/wp-content\/uploads\/2026\/05\/images-2.jpg\" alt=\"\" width=\"646\" height=\"362\" \/><\/p>\n<h5 class=\"t m0 x1 h2 y2 ff1 fs0 fc0 sc0 ls0 ws0\">THERE ARE FOUR KINDS OF DEFECTIVE CONTRACTS.<\/h5>\n<h5 class=\"t m0 x1 h2 y3 ff1 fs0 fc0 sc0 ls0 ws0\">THEY ARE IN THE ORDER OF THEIR DEFECTIVENESS<\/h5>\n<h5 class=\"t m0 x1 h2 y4 ff1 fs0 fc0 sc0 ls0 ws18\">OR EFFICACIOUSNESS:<\/h5>\n<h5 class=\"t m0 x1 h3 y5 ff2 fs0 fc0 sc0 ls0 ws1\">INTRODUCTION<\/h5>\n<h5 class=\"t m0 x1 h3 y6 ff3 fs0 fc0 sc0 ls0 ws2\" style=\"text-align: left;\">(1) Rescissible contracts. <span class=\"ff2 ws3\">\u2014 They are the least infirm or defective.<\/span><\/h5>\n<h5 class=\"t m0 x1 h3 y7 ff2 fs0 fc0 sc0 ls0 ws4\" style=\"text-align: left;\">They are valid because all the essential requisites of a contract exist<\/h5>\n<h5 class=\"t m0 x1 h3 y8 ff2 fs0 fc0 sc0 ls0 ws5\" style=\"text-align: left;\">but by reason of injury or damage to one of the parties or to third<\/h5>\n<h5 class=\"t m0 x1 h3 y9 ff2 fs0 fc0 sc0 ls0 ws3\" style=\"text-align: left;\">persons, such as creditors, the contract may be rescinded. Thus, the<\/h5>\n<h5 class=\"t m0 x1 h3 ya ff2 fs0 fc0 sc0 ls0 ws6\" style=\"text-align: left;\">defect is external. Until such contracts are rescinded in an<\/h5>\n<h5 class=\"t m0 x1 h3 yb ff2 fs0 fc0 sc0 ls0 ws7\" style=\"text-align: left;\">appropriate proceeding, they remain valid and binding upon the<\/h5>\n<h5 class=\"t m0 x1 h3 yc ff2 fs0 fc0 sc0 ls0 ws18\" style=\"text-align: left;\">parties thereto (Chap. 6.);<\/h5>\n<h5 class=\"t m0 x1 h3 yd ff3 fs0 fc0 sc0 ls0 ws2\" style=\"text-align: left;\">(2) Voidable contracts. <span class=\"ff2 ws8\">\u2014 They are also valid until annulled unless<\/span><\/h5>\n<h5 class=\"t m0 x1 h3 ye ff2 fs0 fc0 sc0 ls0 ws9\" style=\"text-align: left;\">there has been a ratification. In a voidable contract, the defect is<\/h5>\n<h5 class=\"t m0 x1 h3 yf ff2 fs0 fc0 sc0 ls0 ws18\" style=\"text-align: left;\">caused by vice of consent (Chap. 7.);<\/h5>\n<h5 class=\"t m0 x1 h3 y10 ff3 fs0 fc0 sc0 ls0 wsa\" style=\"text-align: left;\">(3) Unenforceable contracts. <span class=\"ff2 ws7\">\u2014 They cannot be sued upon or<\/span><\/h5>\n<h5 class=\"t m0 x1 h3 y11 ff2 fs0 fc0 sc0 ls0 wsb\" style=\"text-align: left;\">enforced unless they are ratified. As regards the degree of<\/h5>\n<h5 class=\"t m0 x1 h3 y12 ff2 fs0 fc0 sc0 ls0 wsc\" style=\"text-align: left;\">defectiveness, voidable contracts are further away from absolute<\/h5>\n<h5 class=\"t m0 x1 h3 y13 ff2 fs0 fc0 sc0 ls0 wsd\" style=\"text-align: left;\">nullity than unenforceable contracts. In other words, an<\/h5>\n<h5 class=\"t m0 x1 h3 y14 ff2 fs0 fc0 sc0 ls0 ws5\" style=\"text-align: left;\">unenforceable contract occupies an intermediate ground between a<\/h5>\n<h5 class=\"t m0 x1 h3 y15 ff2 fs0 fc0 sc0 ls0 ws18\" style=\"text-align: left;\">voidable and a void contract (Chap. 8.); and<\/h5>\n<h5 class=\"t m0 x1 h3 y16 ff3 fs0 fc0 sc0 ls0 wse\" style=\"text-align: left;\">(4) Void or inexistent contracts. <span class=\"ff2 wsf\">\u2014 They are absolutely null and<\/span><\/h5>\n<h5 class=\"t m0 x1 h3 y17 ff2 fs0 fc0 sc0 ls0 ws10\" style=\"text-align: left;\">void. They have no legal effect at all and cannot be ratified. (Chap.<\/h5>\n<h5 class=\"t m0 x1 h3 y18 ff2 fs0 fc0 sc0 ls0 ws8\" style=\"text-align: left;\">9.) According to the Code Commission which prepared the draft of<\/h5>\n<h5 class=\"t m0 x1 h3 y19 ff2 fs0 fc0 sc0 ls0 ws11\" style=\"text-align: left;\">the present Civil Code, a great deal of confusion has been created by<\/h5>\n<h5 class=\"t m0 x1 h3 y1a ff2 fs0 fc0 sc0 ls0 ws12\" style=\"text-align: left;\">the faulty terminology used in the old Civil Code as regards<\/h5>\n<h5 class=\"t m0 x1 h3 y1b ff2 fs0 fc0 sc0 ls0 ws5\" style=\"text-align: left;\">defective contracts. There was no sufficient clarity as to contratos<\/h5>\n<div class=\"t m0 x1 h3 y1c ff2 fs0 fc0 sc0 ls0 wsf\">\n<h5>nulos and contratos anulables \u2014 void and voidable contracts. I<\/h5>\n<h5 class=\"t m0 x3 h3 y2 ff2 fs0 fc0 sc0 ls0 ws11\" style=\"text-align: left;\">order to put an end to the uncertainty and other ambiguities in the old<\/h5>\n<h5 class=\"t m0 x3 h3 y3 ff2 fs0 fc0 sc0 ls0 ws11\" style=\"text-align: left;\">Code, the present Code in a clear-cut and unequivocal way classified<\/h5>\n<h5 class=\"t m0 x3 h3 y1d ff2 fs0 fc0 sc0 ls0 ws11\" style=\"text-align: left;\">and defined the various kinds of defective contracts, and stated their<\/h5>\n<h5 class=\"t m0 x3 h3 y1e ff2 fs0 fc0 sc0 ls0 ws1\" style=\"text-align: left;\">consequence<\/h5>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>[feather\/share] THERE ARE FOUR KINDS OF DEFECTIVE CONTRACTS.
